These terms govern your use of meltlyliving.com and any order you place through it. The site is operated by Meltly LLC, 30 N Gould St, Ste 6, Sheridan, WY 82801, United States ("MELTLY", "we", "us"). By browsing the site or placing an order you agree to these terms, so please read them.

1. Using the site

You need to be at least 18, or the age of majority where you live, to place an order. You agree not to use the site for anything unlawful, not to attempt to break, scrape or overload it, and not to resell our products as a MELTLY authorised dealer without our written agreement.

2. Orders and acceptance

Your order is an offer to buy. The confirmation email we send when you check out acknowledges that we received it; the contract forms when we ship. Until then we may decline or cancel an order, including where the item is out of stock, where we suspect fraud, or where there has been a pricing or description error. If we cancel, we refund you in full and tell you why.

3. Prices and errors

Prices are in US dollars and can change without notice, though a change never affects an order already placed. We work hard to keep the site accurate, but if a product is listed at an obviously wrong price we are not obliged to honour it. We will contact you and either confirm the correct price or cancel and refund.

4. Payment

Payment is taken at checkout through Shopify Payments and the accelerated checkout methods shown on the page. We never see or store your full card details. By submitting payment information you confirm you are authorised to use the payment method.

5. Product descriptions, dimensions and colour

We photograph and measure our products carefully, and the dimensions on each page are accurate to within an inch of the assembled piece.

Colour is the one thing a screen cannot promise. Covers differ by model: most pieces use a 3D spacer air-mesh, an open honeycomb knit, and some use a looped bouclé. The material is stated on each product page. Either way its appearance shifts with the light in your room and with the calibration of your display. The colour you receive may differ from the colour you see on screen. This is exactly what the 100-day trial is for, and colour is always a valid reason to return.

6. Delivery, title and risk

Delivery timing is covered by our shipping policy. Title and risk of loss pass to you on delivery to the address you gave us.

7. Returns and warranty

Our refund policy and the warranty terms set out in it form part of these terms.

8. Assembly and use

Our products are for indoor residential use. Follow the instructions in the box. Do not stand on the arms or back, do not drag a loaded piece across a floor, and keep the product away from open flame and direct heat. Damage from ignoring this is not a warranty defect.

9. Reviews and anything you post

If you send us a review, photograph or comment, you keep ownership of it and you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display it in connection with our business, including in marketing. You confirm the content is yours to give and is not unlawful or defamatory. We may edit for length or decline to publish.

10. Intellectual property

The MELTLY name, logo, product designs, photography and site content belong to us or our licensors. You may not copy, reproduce or use them commercially without our written permission.

11. Third-party links

Where we link to another site we are not responsible for its content or its practices. Read its terms before you use it.

12. Disclaimers

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law we disclaim all warranties not expressly stated here, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error free.

13. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to your order or your use of the site is limited to the amount you paid for the products concerned. We are not liable for indirect, incidental, special or consequential damages, or for loss of profits or data. Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

14. Indemnity

You agree to indemnify us against claims arising from your breach of these terms or your misuse of the site.

15. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. The courts located in Wyoming have exclusive jurisdiction over any dispute, and you and we both consent to that jurisdiction.

16. Changes

We may update these terms. The version in force is the one published on this page at the time you place your order, and the date at the top tells you when it last changed.

17. Severability and entire agreement

If any provision is found unenforceable, the rest stays in force. These terms, together with our refund, shipping and privacy policies, are the entire agreement between us regarding the site and your order.
